The 256 Foundation may investigate and act on violations of these terms. The 256 Foundation reserves the right to change, redact, and delete content on the forum for any reason. The 256 Foundation may notify and cooperate with law enforcement authorities in prosecuting violations of the law and these terms. If you believe someone has submitted content in violation of these terms, contact us immediately.
Your Account
To use some features of the forum, you must create an account. To do so, you must provide a valid email address and keep it up to date.
You may close your account at any time by emailing admin@256foundation.org.
You are responsible for all activity taken using your account, whether authorized by you or not, until you close your account or notify us that it has been compromised. Notify us immediately if you suspect your account has been compromised. Use a secure password and keep it private.
The 256 Foundation may restrict, suspend, or close your account if it reasonably believes you have violated these terms.
Your Content
Nothing in these terms gives the 256 Foundation any ownership rights in content you submit — including posts, account information, or other material. Nothing in these terms gives you ownership rights in the 256 Foundation’s intellectual property.
You remain solely responsible for content you submit. You agree not to imply that your content is sponsored or approved by the 256 Foundation.
Content you submit belongs to you, and you decide what permissions to grant others. At a minimum, you license the 256 Foundation to share your content with other forum users — including the ability to copy, publish, and analyze it for that purpose. This license ends when all copies of your content are removed from the 256 Foundation’s systems and backups.
Other licenses you apply to your content — such as open-source or Creative Commons licenses — may continue after removal. You agree that the 256 Foundation will not be liable for others’ violations of the terms on which you licensed your content.
Your Responsibility
You agree to indemnify the 256 Foundation from legal claims by others related to your breach of these terms, or breach of these terms by others using your account. Both parties agree to notify the other of any such claims as soon as possible.
You agree to allow the 256 Foundation to control the investigation, defense, and settlement of any legal claims for which you would have to indemnify the 256 Foundation, and to cooperate with those efforts. The 256 Foundation will not agree to any settlement that admits fault for you or imposes obligations on you without your prior agreement.
Disclaimers
You accept all risk of using the forum and its content. As far as the law allows, the 256 Foundation and its contributors provide the forum as is, without any warranty whatsoever. The forum may link to or integrate services run by others. The 256 Foundation makes no warranty about those external services or their content.
Limits on Liability
The 256 Foundation is a nonprofit 501(c)(3) organization operating this forum as a community resource. To the fullest extent permitted by law, the 256 Foundation and its officers, directors, employees, and volunteers shall not be liable to you for any damages — direct, indirect, incidental, special, consequential, or exemplary — arising from your use of or inability to use the forum, or from any content on the forum.
Feedback
The 256 Foundation welcomes feedback and suggestions. See the Contact section below. You agree that the 256 Foundation may act on any feedback you provide without obligation to notify you, get your permission, or compensate you. Do not submit feedback you consider confidential or proprietary.
Termination
Either you or the 256 Foundation may end this agreement at any time. When the agreement ends, your permission to use the forum ends. The following provisions survive termination: Your Content, Feedback, Your Responsibility, Disclaimers, Limits on Liability, and General Terms.
Disputes
Tennessee law will govern any dispute related to these terms or your use of the forum. You and the 256 Foundation agree to seek injunctions related to these terms only in state or federal court in Nashville, Tennessee, and neither party will object to jurisdiction, forum, or venue in those courts.
General Terms
If any provision of these terms is unenforceable as written, it should be modified to the minimum extent necessary to make it enforceable, or removed if it cannot be. You may not assign your agreement with the 256 Foundation. The 256 Foundation may assign this agreement to any affiliate or successor organization. These terms represent the entire agreement between you and the 256 Foundation regarding use of the forum and replace any prior agreements.
